I Thomas Darch of Bishops Hull in the County of Somerset Esquire do make and ordain this my last will and testament in manner following (that is to say)
First I will and direct that my body be decently interred in the Parish Church of Bishops Hull aforesaid as near as may be to the place where my late wife lies buried. Also I give fifty shillings to each of my menial and domestick servants that shall be living with me and in my service at the time of my death. Also I give five pounds to be distributed to and amongst the poor inhabitants of the said Parish of Bishops Hull at the discretion of my trustees herein after named or of the major part of them. I give and devise unto my good friends Thomas Welman of Lower Poundisford Esquire Isaac Welman of Higher Poundisford Esquire John Halliday of Yard Esquire Simon Welman of Lower Poundisford aforesaid and Thomas Darch Esquire late of Woolavington but now of Churchill Gentlemen all in the said County of Somerset All that my manor and ffarm called Week Park and All that my ffarm called Quantock situate lying and being in the Parishes of Over Stowey and Stogursey in the said County together with all messuages lands and tenements and hereditaments thereunto respectively belonging and now held used occupied and enjoyed therewith and the Reversion and Reversions Remainder and Remainders Rents Suits Services Issues and profits thereof and every part and parcel thereof To Hold the same Manor ffarms Lands Tenements Hereditaments and Premises unto them the said Thomas Welman Isaac Welman John Halliday Simon Welman and Thomas Darch their Heirs and Assigns for ever In Trust nevertheless that they or the survivors or survivor of them or his Heirs and Assigns shall as soon as conveniently may be after my decease make absolute sale of the said Manor ffarms Lands Tenements and Premises either entirely or by parcells as to them or him shall seem most meet for the most money or best price or prices than can reasonably be gotten for the same and the Moneys arising by such sale shall lay out or place in some or one of the publick Stocks or ffunds or on some Government Security and the Income and Produce thereof shall pay and apply to such person or persons and in such manner and to and for such uses Ends and purposes as herein after is mentioned and directed. And Whereas I have by a dormant surrender bearing the date the twenty first day of this instant surrendred into the hands of the Lord of the Manor of Taunton Deane in the county aforesaid All my Messuages Tenements Lands and Cottages whatsoever lying within and parcells of the same Manor to the use and eschoof of the before named Thomas Welman Isaac Welman John Halliday Simon Welman and Thomas Darch their Heirs and Assigns for ever according to the custom of the said Manor Subject to the performance of my last Will and Testament. Now my will is and I do direct and appoint that Mary my beloved wife together with her necessary servants and Attendants (such and so many as she shall think proper) shall and may live in use and occupy All that the best part of my Messuage of Dwelling House at Bishops Hull aforesaid where I now inhabit (to wit) the Rooms called the Hall, the best Parlour and the papered Room not yet finished which I intend for a Study, together with the best fflower Garden and the walled part of the Kitchen Garden for such time only and until my son Thomas Darch shall attain his full age of one and twenty years Upon Condition nevertheless that my said wife shall during such time be and continue my widow and not otherwise and for and during such time as my said wife shall live in the best part of my said Dwelling House as aforesaid and under the condition before mentioned I give and bequeath to her the use of all my Household Goods, ffurniture plate and pictures which shall be in my said Dwelling House at my death. And my will [touching] my wife’s having use of my household goods ffurniture and plate and pictures as aforesaid further is that she my said wife do and shall within three months next after my decease deliver or cause to be delivered to each severally of my Executors herein after named then living an exact perfect and true schedule or particular in writing under her hand of all the said household goods ffurniture plate and pictures which by virtue of this my will she is as aforesaid to have the use of with the exact weight of every such piece of plate and that she do in such time enter into an obligation to my said Executors in the penalty of one third part at least more than the value of the said goods ffurniture plate and pictures shall then unto conditioned for the leaving of such goods ffurniture plate and pictures at the time of my said son’s attaining his age aforesaid or of the Marriage or Death of her my said wife (which of them so ever shall first happen) in as good condition as they respectively then are (involuntary accidents, necessary use and wearing only excepted) and that if she fails in or refuses to give such particular and Bond, my Bequest to her of or for her using or having such goods ffurniture plate and pictures in manner aforesaid shall then be absolutely void. Further in pursuance of the before mentioned dormant surrender my will is and I give and devise all my Messuages Tenements and Lands whatsoever held of the said Manor of Taunton Deane (subject to my wife’s living in my said Dwelling house and using the best fflower garden and walled part of the Kitchen Garden as aforesaid) unto the aforesaid Thomas Welman Isaac Welman John Halliday Simon Welman and Thomas Darch their Heirs and Assigns for ever. I also give and devise unto them their Heirs and Assigns for ever the Tyths of the fforest of Exmoore in the counties of Somerset and Devon and all of my other Lands Tenements and Hereditaments whatsoever and wheresoever (not herein before devised) In Trust nevertheless for my said son Thomas Darch until he shall attain his age of one and twenty years and after my said son shall have attained that age then in trust for him my said son his Heirs and Assigns for ever But in case my said son shall happen to dye before he shall attain his said age of one and twenty years without Issue of his Body lawfully begotten that shall be then living and I shall have no other Child or Children lawfully begotten at my death then In Trust for my sister Mary Hall wife of Jonathan Hall of Croydon in the said county of Somerset Gentleman for and during the term of her natural life and after the death of the said Mary Hall then In Trust for the said Thomas Darch of Churchill aforesaid his Heirs and Assigns for ever. I give and devise unto my said wife for and during the term of her natural life One clear Annuity or clear yearly sum of fifty pounds to be paid by four quarterly payments in the year and the first such quarterly payments to begin and to be made at the end of three Kalendar months next after my decease and I do will and direct that the said Annuity of fifty pounds shall be paid out of the Interest Incomes or Produce of the purchase moneys which shall arise from the sale of my Manor and ffarm of Week Park and Quantock ffarm and other lands and hereditaments herein before devised to my Trustees to be sold and the purchase money therefrom arising shall be placed out on security as aforesaid I do direct that the said Annuity shall be raised and paid out of my said Taunton Deane lands, which lands I charge for the payment thereof accordingly which said Annuity of fifty pounds a year hereby given to my said wife. I do declare is to be and to be so deemed and taken in lieu of an Annuity of fifty pounds charged and made payable to her out of my said Manor and ffarm of Week Park and Quantock ffarm and other lands in the said parishes of Over Stowey and Stogursey pursuant to Marriage Articles with my said wife. Also I give and devise unto my said wife her Heirs Executors Administrators and Assigns all and every the Messuages Tenements and Lands as well ffreehold as Leasehold lying in the parish of West Monkton in the said County of Somerset which were settled or conveyed by Thomas Musgrave Gentleman my wife’s father to Trustees on our intermarriage and that all my Estate right Title and Interest therein respectively Subject nevertheless to the payment there out or some part thereof of the sum of three hundred pounds to the said Thomas Musgrave his Executors Administrators or Assigns as by such settlement or conveyance is declared and agreed to be paid Provided always and my will is [touching] the devise of the said Messuages Tenements and Lands in West Monkton aforesaid to my said wife and of the said Annuity hereby given her and I do declare that the same are so devised and given to her upon this express condition that she my said wife shall and will (upon reasonable notice and request) Release to my said Devisees in Trust or to the Survivors or Survivor of them and his or their Heirs or to such person or persons who shall become purchasor or purchasors of my said Manor and ffarms of Week Park and Quantock ffarm and other premises herein before directed to be sold or of any part or parts thereof her said Annuity or clear yearly sum of fifty pounds a year charged upon and made payable out of the same Manors ffarms and Lands by virtue or in pursuance of our Marriage Articles and every part of such her said Annuity and all her Right Title claim and demand whatsoever therein or thereto or out of or upon the said Manor ffarms and Lands or any part thereof for or on Account of the same Annuity. But if she my said wife shall neglect or refuse so to do after reasonable Notice given and Application made to her for that purpose then and in either case my will is and I do declare that the devise and bequest to her as well of the Annuity of fifty pounds a year herein before given her as of the said Messuages Tenements and Lands in West Monkton aforesaid and all such Benefit therefrom shall cease and become absolutely void the said Annuity hereby given her shall from thenceforth sink into and become part of my Residuary Estate and the said Messuages Tenements and Lands in West Monkton aforesaid I do then and from thenceforth devise to my said Trustees their Heirs Executors Administrators and Assigns upon the like Trusts as my said Taunton Deane Lands are herein before devised. I give unto my said wife all her Apparel, Watch, Rings, Jewels and all other her paraphernalia, I also give unto her one hundred pounds for Mourning to be paid in six months next after my decease out of the Moneys which shall first come to my Trustees hands. All the rest and residue of my Goods, Chattels, ready Moneys, Securities for Moneys, personal and Testamentary Estate whatsoever (after payment of my Debts Legacies and funeral Expenses) I give and bequeath unto the aforesaid Thomas Welman Isaac Welman John Halliday Simon Welmand and Thomas Darch whom I constitute and appoint Executors of this my last will and testament In Trust nevertheless for my said son Thomas Darch and in case of his death before he shall attain the age of one and twenty years then In trust for such other person or persons who shall be intitled to enjoy my Taunton Deane Lands and in like manner as the same are herein before directed to be enjoyed. And my further Will is and I do so order and declare that my said Trustees or such of them who shall take upon them and act in the Trust of this my Will or the Major part of such acting Trustees shall have full power and Authority to appoint from time to time one or more person or persons to be a Receiver or Receivers Agent or Agents under them for the collecting and receiving the annual or other Rents and Profits of the said Trust Estates and Premises and for the Supervising taking care of or otherwise managing the same Estates as they my said Trustees shall think fit and proper and to pay or allow out of the Trust moneys to such Receiver or Receivers Agent or Agents such yearly or other Sallary or Pension Sallaries or Pensions as they my said Trustees or the Major part of them acting under the said Trusts shall judge reasonable and sufficient and that my said Trustees nor either of them shall be answerable or accountable for any Moneys in the Hands of such Receiver or Receivers Agent or Agents and not paid over or accounted for to them my said Trustees, nor be answerable for any Default or Misapplication of any of the Trust Moneys by any such Receiver or Receivers Agent or Agents. And I do further will and declare that neither of my said Trustees nor either of their Heirs Executors or Administrators shall be answerable or accountable for the Acts Deeds Receipts or Defaults of the other or of their Heirs Executors or Administrators but each one for himself his own Heirs Executors or Administrators and his and their own Acts Deeds Receipts and Defaults only nor shall any of them respectively be answerable for any money but what shall actually be received by them or their order respectively and that my said trustees and their respective Heirs Executors or Administrators shall and may out of the Trust Estate and Effects hereby vested in them retain to and reimburse themselves for all Costs Charges Damages and Expenses that they respectively shall or may reasonably expend sustain or be put unto in and about the Execution of the Trusts hereby in them reposed. I give five guineas unto each of my said Trustees who shall take upon him and them and act in the Trust of this my Will and I do hereby appoint my said Executors in Trust to be the Guardians of and for my said son Thomas Darch during his Minority and I so make it my particular request to the said John Halliday that he will take care of my said son’s Education and that my said son may be educated in the like manner and at the same School and Academy with his the said John Halliday’s sons and I do direct that my said Trustees shall and may pay and allow from time to time any sum or sums of money in and for and about the Maintenance and Education of my said son as they shall think proper I give and bequeath unto the said Thomas Welman Isaac Welman John Halliday Simon Welman and Thomas Darch the sum of one hundred pounds to be by them or the Survivor or Survivors of them or the Executors or Administrators of such survivors laid out in the purchase of some Estate of Inheritance either in fee simple, customary freehold, customary copyhold, or for a long Term or Terms of years absolute and by them or him settled and assured by such ways and means in the Law as Counsel shall so advise In Trust that the clear yearly Rent and profits of the same shall be paid and applied unto or for the use of such person or persons as shall be Minister for the time being or Ministers (if more than one) of the congregation of Protestant Dissenters called Presbyterians within the said parish of Bishops Hull during the continuance of such Meeting there and in the mean time and until such purchase made, my said Trustees or the Survivors or Survivor of them or the Executors or Administrators of such Survivor shall place out the said one hundred pounds at Interest on good reall Security and shall pay the Interest thereof yearly unto such Minister or Ministers as aforesaid Which Interest or Rent it is my Will shall be paid in two equal payments and proportions in the year (to wit) on the twenty fifth day of December and the twenty fourth day of June, the first payment to begin on such of the said days as shall first happen next after my death and in case of a Discontinuance or dropping of such Meeting or Congregation the said Rent or Interest shall then be paid and applyed for teaching and instructing poor Children of the said parish of Bishops Hull to read and write and in buying Books for such purposes and I do revoke all former Will and Wills by me made. In Witness whereof I have to this my last will and testament written or contained in four sheets of paper affixed together set my hand and seal to each sheet thereof this twenty third day of October in the year of our Lord one thousand seven hundred and fifty two.______ I give unto Samuel Birknell of Bishops Hull aforesaid the sum of ten pounds – Tho Darch – signed sealed published and declared by the said Thomas Darch the Testator as and to be his last will and testament in the presence of us who, at his request and in his presence and in the presence of each other have subscribed our names as Witnesses thereto (the Legacy to Samuel Birknell of ten pounds being first inserted or added – John Gunston – Samll Stodden - Trevillian Ceely

This Will was proved at London the eighth day of January in the year of our Lord one thousand seven hundred and fifty five before the Right Honourable Sir George Lee Knight Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oaths of Isaac Welman Simon Welman and Thomas Darch Esquires three of the surviving Executors named in the said Will and to whom Administration was granted of all and singular the Goods Chattels and Credits of the deceased having been first sworn by Commission duly to administer power reserved to make the like Grant to Thomas Welman the other surviving Executor named in the said Will when he shall apply for the same.
