This indenture made the seventh day of April in the first year of the Reign of our Sovereign Lord George the Third by the Grace of God over Great Brittain France and Ireland King Defender of the Faith and so forth and in the year of our Lord one thousand seven hundred and sixty one.
Between Elizabeth Houle of the parish of Landkey in the County of Devon Spinster of the first part and Simon Darch of the same parish miller of the second part and William Darch of the parish of Swymbridge of the other part.
Whereas there is a marriage by God’s permission shortly to be had and solemnized by and between the sd William Darch and the sd Elizabeth Houle and whereas the sd Elizabeth Houle now is Seized and proposed of a considerable Sum of money & Some other Goods and Chattles.
This indenture witnesseth that the sd Elizabeth Houle for and in Consideration of the said intended Marriage as also for an in Consideration of one Shilling of Lawful money of Great Brittain to her in hand payed by the sd Simon Darch at and before the Sealing and Delivery of these presents the receipt whereof is hereby acknowledged by the sd Elizabeth Houle hath granted assigned and setover and by these presents doth Grant Assign and Setover unto to above named Simon Darch two puter [pewter] dishes and one iron pot and Ten pounds in money unto the sd Simon Darch His Executors Administrators & Assigns from and immediately after the day and date aforesd.
For the Use Intents and purposes Hereinafter Mentioned and Expressed and to other use Intent or purpose Whatsoever (that is to say) For the only use and behoof of Mary Darch Daughter of the Said William Darch And upon further Trust and Confidence The Sd Simon Darch His Executors Admins and Assigns Shall peaceably and quietly have hold possess and Enjoy all and Singular the aforesd recited Goods and Sum of money intrust and for the only use and behoof of the aforesd Mary Darch
Without the let, suit or denial of her the Sd Elizabeth Houle or any other person or persons whatsoever Lawfully Claiming or to Claim And the Sd Simon Darch for himself his Executors Admins and Assigns doth Covenant promise and agree to and with the Sd Elizabeth Houle her Execs Admins and Assigns that he the Sd Simon His Execus and Assigns Shall and will hold use and dispose of the Sd goods and sum of money before mentioned to and for the Sole and Separate use of the aforsd Mary Darch to the true and Intent and meaning of these presents.

This must be either Mary Dart or Mary Brealey. One is the wife of a Carpenter, the other the wife of a Labourer. The William who was a carpenter, and left a will and died in 1838, has a daughter Sally - and therefore this is Mary Dart, as the other Mary married her William (the Labourer) after Sally was born and continued to produce children after this death.

This is the last Will and Testament of me, William Darch of Landkey in the County of Devon, Carpenter.
First I give and bequeath unto my Daughter Sally Mock All those three Dwellinghouses and Gardens with the appurtenances thereto belonging together with the Buildings now existing in the Orchard adjoining the Gardens intended for Pigs Houses situate at Landkey Newland in the County of Devon and now in the occupation of James Harding ... and John Cunnebeare as tenants thereof to her and her heirs for ever. and in case my said Daughter should die without lawful issue then I direct that immediately after her death the lower House now in the occupation of John Cunnibeare shall be held and enjoyed by my Granddaughter Elizabeth Darch and her heirs for ever and the remainder to my Son John Darch and his heirs for ever without power to sell or alienate the same. I give and bequeath unto my said Daughter Sally Mock the house at Street now in the occupation of William Thorne together with the portion of the Field and Orchard attached thereto I give and bequeath unto my son John Darch during his natural life the Dwelling house Orchard & Garden with the appurtenances thereto belonging now in my occupation siutate at Landkey Newland aforesaid together with the Dwellinghouse and Garden adjoining, now unoccupied, and after his death to his heirs for ever reserving out of the Orchard the ground occupied by the Pigs Houses I give and bequeath unto my said son John Darch my House at Street now in the occupation of Thomas Boutly together with that portion of the Field and Orchard now attached thereto. I give and bequeath unto my said son all my working tools and wearing apparel I give and bequeath unto my said Son the sum of five pounds. All the rest remainder and residue of my Goods Chattles and Effects I give and bequeath unto my said Daughter Sally Mock whom I constitute and appoint sole Executrix of this my last Will and Testament. This is the last will and testament of me Philip Darch of Landkey in the County of Devon Cordwainer. I give and bequeath to my daughter Mary Darch the sum of One Pound. I also give and bequeath to my said daughter the money which will become due to my representative the money from the sale of my house in Albraham Wards occupation in the village of Landkey Newland aforesaid. All the rest residue and remainder of my goods Chattels and Effects of whatsoever nature or kind I bequeath unto my wife Elizabeth Darch whom I constitute and appoint sole executrix of this my last Will & Testament In witness where of I have hereunto set my hand and seal this 8th day of April One Thousand Eight Hundred and thirty three.
