There are two possible John Darch - sons of Robert and Jane Perkins (1754) and of John and Mary Hill (1753). This couple appear to have five children: Mary, Jane, William, Elizabeth and Sarah. Robert and Jane's children include a Jane and an Elizabeth, John and Mary Hill's do not. Neither has a Sarah. The witness can only be the son of John and Mary Hill (1860). It's impossible to determine which John this is, so I haven't made an assumption and started a new tree instead.

This is the last will and testament of me John Darch of Horra Mills in the parish of Winkley in the county of Devon miller. All the Fee Simple & Inheritance of in and to All That Overland Estate & Premises called Slads or Slades Down now in my Possession in the said parish of Winkley Subject to The Mortgage I have Made Thereon to Mrs. Susanna Snell of Chumleigh & also To the Two Several Sums of £150 to be paid out of the same premises to My two Sons Robert Darch & Thomas Darch making together the sum of £300 within one Year after my decease with the payment of which said Several Sums due on the Mortgage of the Premises & the said sum of £150 each making £300 Subject & Charge [?} the Same Premises, and Subject Thereto I Give Devise and Bequeath the same premises unto my Eldest Son John Darch to Hold to my said Son John Darch Subject as aforesaid His Heirs & assigns for ever.

Also I give and forgive unto my Son Richard Darch All Such Sum & Sums of Money as He should owe w Stand Indebted to me in at the Time of my death, & I also Give & Bequeath unto my Said Son Richard all The Estate Right & Interest which I Have Of & in all Those Mills and Places called pullings Mills or Lower Seckington in High Bickington in the County of Devon.

Also I give & Bequeath unto my Son Robert Darch The Sum of £150 To be paid & payeth as aforesaid out of my Said Estate Called Slades Down which i have before Devised charged with The payment Thereof to my said Son John to Be paid within One Year after my Death And I Also Bequeath unto my said Son Robert any Interest or Right I May have in Newland Mills in North Tawton, And also The Best Horse I may die owner of at the Choice of my Said Son Robert.

Also I Give & Bequeath unto my Daughter Mary the Now Wife of John Letheren the annuity or Sum of four pounds a Year To be paid by my [?] out of My messuage & premises called patience[?] orwise Marsh[?] Mills during The Right I now have in the Same: the Same Annuity to be paid her by four Equal quarterly payments every Year Into her own Hands & upon her own Separate Receipt without being Subject to the Debts or Control[?] of Her Husband.* And All the Rest Residue & Remainder of my Estate goods Chattels & Effects Subject to my Debts Except The Moneys Due from me on Mortgage of the Lands called Slades I Give & Bequeath the Same Unto my Son Thomas Darch & I do Hereby Constitute & Appoint my said Son Thomas Darch whole & Sole Exor of this my Last Will Revoking hereby all former Wills by & Declaring this to be my Last Will & Testament for Witness.

I Robert Darch of Hollacomb in the Parish of Winkleigh in the County of Devon Cordwainer being of perfect mind and memory do make and ordain this to be my last will and testament and first recommend my spirit into the Hands of Almighty God [...]
I give unto John Darch my beloved son all that Dwelling House the lower side of the passage belonging to West... Great Orchard and Garden & Linhay, and Pig House belonging thereto and the House opposite & half of the Court and if any poor Rates is charged the old house to pay the same and after the death of my son John Darch to remain to his wife during her life and after her decease to come to Robert Darch, son of John and Amy Darch
I give unto Amy Parkhouse my Granddaughter and Daughter of William Francis all that Dwelling House Coppice and Garden being a part & parcel of a Messuage and Tenement called & known by the name of Pykes during my right therein situate at Hollacomb aforesaid which I hold under an Assignment from Simon Down the paying therefrom yearly and every year the sum of ten shillings to Ann Parkhouse her sister also to Sarah Francis her sister the sum of fifteen shillings yearly and every year also one shilling to Simon Down yearly and every year.
The above Dwellinghouse Coppice and Garden is given to Amy Parkhouse separate and apart from her husband during the right therein.
I give unto John Francis and Ann his sister [Horramans?] now occupied by John Partridge.
I give unto Elizabeth Morrish the Higher part of the Dwelling House belonging to Westacotts [...] above the passage and also the other houses above the passage also Orchard and Garden and the Shippin Pig Houses and the other half of the Court and also the residue of my effects not before mentioned such as all Goods Chattles Monies, Household Goodsand Furniture of any Description whatsoever I give unto Elizabeth Morrish whom I make and ordain my whole and sole Executor of this my last Will and Testament and will is that all my first Debts shall be discharged together with my funeral expenses and the proving of this my Will shall be paid before any legacy is paid and I do hereby revoke and disallow all and evry will by me made declaring this to be my last will and testament.

In the Name of God Amen. I Thomas Darch of Winkleigh in the County of Devon Yeoman do hereby make this my last Will and Testament as follows. That is to say - I give and bequeath to my son Thomas Darch the sum of Five Pounds to be paid by my Executor hereinafter named out of my personal Estate within twelve Calendar months after my decease. I also give and bequeath unto my daughter Frances Mugridge One Hundred Pounds to be paid by my Executor out of my Personal Estate in manner following. That is to say the first instalment of Twenty Five Pounds at the end of twelve calendar months after my decease and to continue yearly during the remainder of four years. But in case she my said Daughter Frances should happen to die during the said four years and not having received the whole of such legacy Then and in that case the actual amount remaining unpaid shall be and remain for the benefit of her children share and share alike to be paid by my Executor when and as they attain the age of twenty one years respectively. I also give devise and bequeath unto my son in law William Jerrett the House and premises wherein he now resides situate in Winkleigh aforesaid called or commonly known by the name of Fulfords [?] To have and to hold the same during his life and from and after his decease I give devise and bequeath the same unto his Daughter Mary Ann Miller her Heirs Executors Administrators and Assigns forever.
